No conflicting application is before the <br />Conunission. <br /> <br />(3) <br />lands of <br />est. <br /> <br />The project to be studied hereunder would affect <br />the United States within the White River National For- <br /> <br />(4) <br />denied. <br /> <br />The motion to dismiss filed July 5, 1972, should be <br /> <br />The Commission orders: <br /> <br />'(A) The motion to dismiss filed July 5, 1972, is hereby <br />denied. <br /> <br />(B) A preliminary permit is issued to The Colorado River <br />Water Conservation District (Permittee) for the proposed South <br />Fork of White River Project No. 2647 located in Garfield and <br />Rio Blanco Counties, Colorado, affecting lands of the United <br />States within the White River National Forest, for a period of <br />36 months, effective as of the first day of the month in which <br />this permit is issued, subject to the terms and conditions of <br />the Federal Power Act, which is incorporated by reference <br />as part of this permit, and subject to such rules and regulations <br />as the Commission has issued or prescribed under the provisions <br />of the Act, <br /> <br />(C) This permit is also subject to the terms and conditions <br />set forth in Form P-l (FPC)- entitled "Terms and Conditions of <br />Preliminary Permit", (16 FPC 1303-1305), which terms and condi- <br />tions (designated as Articles 1 through 8) are attached hereto <br />and made a part hereof, and subject further to the following <br />special conditions set forth as additional articles: <br /> <br />Article 9, The permittee shall develop in coordination with <br />the District Engineer, U.S. Army Engineer District, Sacramento, <br />California, the necessary operating criteria for any flood con- <br />trol storage capacity to be incorporated in the project. <br /> <br />Article 10. The Permittee shall consult with the U.S, Forest <br />Service to establish a mutually satisfactory maximum water sur- <br />face elevation for the proposed Rio Blanco Reservoir. <br />
