.

.

Ci)
00
L~ Members, CWCB
y~ March 14, 1989
t', Page two

~-.')

potential problem, I have proposed to Reclamation
that the first payment from the state would not
be due and forthcoming until construction on
Stage 4 is completed or the first construction
contract on Stage 5 is awarded, whichever occurs
first. At that time, the state would make a
lump sum payment to Reclamation for one-third of
all costs incurred by Reclamation beyond $75
million as is required by last year's legislation.
From that point forward the Board would make its
cost-sharing payments concurrently, up to the
legislated limit of $6 million. It tentatively
appears that this arrangement is acceptable to
Reclamation and I recommend it to the Boar~ as it
obviously protects the Board's position.

Unless the Board has any concern about these three principal
positions, I will proceed to conclude negotiations with Reclama-
tion, with the final proposed cost-sharing agreement being
subject to final action and approval by the Board at a subsequent
meeting, hopefully in May.

BMcD:mm
