Recreation and pleasure." <br /> <br />To carry out the right and duty of the State to develop and <br />conserve its water reaourcee for the authorized purposes, the Legis- <br />lature has created an administrative-regulatory agency known ae the <br />Board of Water Enaineere and hae invested this Board with broad powers <br />with respect to the appropriation and utilization of public waters. <br />The Board is composed of three members appointed by the Governor for <br />s tarm of six years. Art. 7478. "It is suthorized to pass upon all <br />applications for permits to appropriate stata waters, to inspect all <br />impounding, diversion and diatributing works, to condemn all such <br />structurea that it may deem to be dsngerous, to adjust controvsrsies <br />between lsnd owners and water purveyors, and to fix ressonable rates <br />for the furnishing of vater for the purposes designated by the statute." <br />44 Tex. Jur. 26-27. <br /> <br />Section 59b of Article 16 of the Constitution of Taxae <br />authorizes the creation wi thin the State of <br /> <br />". . . such number of conservation snd <br />reclamation districts as may be dstermined to <br />bs essential to the accomplishment of the pur- <br />poses of'this amendment to the constitution, <br />which districts shall be governmental agencies <br />and bodies politic and corporate with such <br />powers of goveroment and vi th the authority to <br />exercise euch righte, privilegee and functions <br />concorning the subject matter of this amendment <br />as may be conferred by lav." <br /> <br />Under thie conservation amendment, ths Legislature has <br />authorized ths creation and organization of conservation and reclamation <br />districts "in any manner that water improvement, drainage, or levee im- <br />provement districts ars authorized by the lawe of this St~te to be crsate~, <br />and for the several purposes therein provided."
