<br />o <br />C) <br />..... <br />W <br />~ <br />r~ <br /> <br />. <br /> <br />. <br /> <br />STATl!MENT <br /> <br />STATE OF TEXAS <br /> <br />Northern Texas, and the P8nhandle, nearly all of which provides <br />runoff for the Red River, Canadian Rivsr, and other streams forming a <br />part of the Arkansas-White-Red Basin area, is an illlportant section of <br />the State of Texas. It is the location of many important cities and <br />toYns, that have undertaken development of an area that is and will be <br />an important part of Texas and of the United States. The dsvelopment of <br />the area, however, has been affected by many difficultiss, one of vhich <br />is the lack of vater. It is an area that is forced to do the best it <br />can vith the water svailable, and in many cases vhere it is known that <br />vater of excellent quality cannot be obtainsd at a reasonable cost, it <br />is using and will bs forced to use vatsr of a quality that would be <br />questionable in othsr parts of the country. <br /> <br />It is understood that the subject before this Subcommittss is <br />that of jurisdiction in the DIIInner in which it affects ths interstate <br />and intrastate control, conservation, utilization, and pollution of sur- <br />face and ground vater, as stated in the letter from the Secretary, <br />Mr. Clark, dated September 18, 1950. <br /> <br />As concsrns the vaters in Texas which may be affected thereby, <br />the subject is tholl8ht to be very broad, and a complete analysis could <br />not be prepared on short notice. The following is submitted in the hope <br />it may be of some help concerning the problem at this time. <br /> <br />"It is considered that the effect of the State lavs <br />as concerns vater Jurisdictional problems 18 that the develop- <br />ment of any project involving the use by Vllter belonging to <br />Texas, or allotted to Texas by compact or agreement, either <br />surface or ground water, should proceed in accordance with <br />the Vllter laws of Texas, and in full cooperation vith the <br />proper State sgencies." <br /> <br />Report by A.
