<br />Storage may occur until March 15 or until the 4500 acre-foot <br />account is filled, whichever occurs first. <br />b. The compact flow in the Purgatoire River at the Las Animas <br />gaging station will be determined by multiplying the quantity of <br />the daily streamflow in the Purgatoire River at the Ninemile <br />gaging station by 1.1. In the case that flows at the Las Animas <br />gaging station are less than 1.1 times the flows at the Ninemile <br />gaging station, all flows at Las Animas will be considered <br />compact flow. Ninemile and Highland may store on a daily basis <br />flows which exceed the compact flow at Las Animas, subject to <br />condition 4.a. above. <br />c. Winter storage water delivered to the account of Ninemile and <br />Highland will be treated as "other water" under Section III of <br />the 1980 Resolution Concerning an Operating Plan for John <br />Martin Reservoir and subject to a 35 percent storage charge. <br />The storage charge will be allocated to the Kansas transit loss <br />account on April 1. <br />d. Evaporation will be charged against the winter storage water in <br />the Highland and Ninemile account for the time it actually is in <br />storage. The same Cormulas and procedures will be used for <br />these calculations as are used Cor the other accounts in John <br />Martin Reservoir. <br />5. The winter water remaining in the Ninemile and Highland account <br />will revert to the conservation pool on November 1, 1985. <br />6. This winter storage plan will be in effect for one year only. <br />7. Prior to considering the approval oC any time extension of the <br />Ninemile-Highland winter storage plan, Ninemile and Highland <br />must submit the following information to the Administration for its <br />review: <br />a. Documentation oC the area irrigated by Ninemile and by <br />Highland. This documentation should include information which <br />quantifies both the present irrigated acreage and the acreage <br />irrigated prior to 1948. <br />b. Documentation oC the past and present capacities of the <br />Ninemile and Highland ditches. <br />8. Participation in this winter storage program is not intended to <br />affect the water rights owned by the Highland and Ninemile in any <br />way. The approval of this plan by the Administration does not <br />constitute a waiver by either Kansas or Colorado of any rights it <br />has under the terms of the Arkar.sas River Compact. <br />Entered this _ day of December, 1984, at the regular annual <br />meeting of the Administration held in Lamar, Colorado. <br />Frank G.
