<br />, <br />,-- <br /> <br />i <br />~. <br />I~ ~ <br />~ <br /> <br />contained herein to allow Ninemile and Highland to operate a winter <br />storage program on a one year trial basis; <br />WHEREAS, the Administration finds that the provisions of this <br />temJX>rary winter storage plan are in compliance with the Arkansas <br />River Compact and the Rules and Regulations and By-laws adopted by <br />the Administration; <br />NOW THEREFORE, be it resolved that the Administration approves <br />and adopts the following temporary winter storage program for Ninemile <br />and Highland: <br />1. A winter storage account, not to exceed 4500 acre-feet in volume, <br />will be established in John Martin Reservoir for Ninemile and <br />Highland. This account will be available for the 19115 compact year. <br />2. The winter storage period will begin on November 16, 1984, and end <br />on March 15, 1985, The Highland and Ninemile will accrue winter <br />storage water in their account during this period as determined by <br />conditions set forth below. Ninemile and Highland will not divert <br />water at their headgates during the specified period. Diversions at <br />the Ninemile and Highland headgates may resume on March 16, <br />1984. <br />3. The winter storage water in the Ninemile and Highland account <br />will be available for the use of the Ninemile and Highland by <br />exchange during the 1985 irrigation season. The winter storage <br />water can be exchanged when water diversions into one or both of <br />these ditches are heing regulated to satis!y senior water rights <br />downstream in Water District 67. An exchange can be implemented <br />by either of the two companies by having water released !rom the <br />account to compensate for increased water diversions at its <br />headgate. Releases will be made on a one-!or-one basis with out-o!- <br />priority diversions by the ditches, No transit loss 'credit' will be <br />allowed. Water in the Ninemile and Highland winter storage <br />account shall only be exchanged !rom the John Martin Reservoir to <br />either the Ninemile headgate or Highland headgate !or direct <br />irrigation use. Under no circumstances shall this water be <br />exchanged or used in any other !ashion, At the end o! the compact <br />year, any water lell in the Ninemile and Highland winter storage <br />account will accrue to conservation storage. <br />4. The winter storage plan will be administered on a daily basis by the <br />Division Engineer acting in both of his capacities as the Division <br />Engineer and the Operations Secretary !or the Compact <br />Administration. The program will be administered by the !ollowing <br />terms: . <br />a. NinemiJe and Highland may store flows on a daily basis in <br />excess of the compact flows of the Purgatoire River at the Las <br />Animas gaging station, subject to the following two limitations: <br />i. The storable quantity will be computed by multiplying the <br />quantity o! daily streamnow in the Purgatoire River at the <br />Ninemile gaging station by 0.75. <br />ii. The daily rate o! delivering winter storage water to John <br />Martin Reservoir shall not exceed the decreed diversion <br />capacities of the two ditches. The decreed diversion <br />capacities are 62.5 ds !or the Highland and 75 ds !or the <br />Ninemile and will be used as the upper limit for this season. <br /> <br />57 <br />
