<br />the rights of the United States, I refer particularly to article IX of
<br />the compact, Also, in setting up the administrative organization
<br />which will handle this matter, if and when the compact goes into
<br />effect, by providing that the chairman of that agency shall De a Fed-
<br />eral representative, if the President of the United States sees fit to
<br />appoint one, althongh that chairman does not have a vote,
<br />Also, we have fully recognized, I believe, the rights of the United
<br />States Army engineers, bearing in mind the responsibility of that
<br />agency in the maintenance and operation of this reservoir as a flood-
<br />control unit:
<br />Mr, Vidal emphasized the fact that we had a great deal of difficulty
<br />in our own State because of the fact this reservoir was so located that
<br />it radically changed the position in many ways of users above the reser-
<br />voir and below the reservoir. We feel that we have equitably'i~oned
<br />that out by providing that when there is water in the reservoir the
<br />use~s above the reservoir, who np to this time have had to operate
<br />strictly according to decrees and according to priorities, may' have
<br />the advantage of disregarding senior rights below, because those users
<br />below, having the senior rights, now have the benefit of a controlled
<br />storage, which is much more efficient and valuable,
<br />As has been mentioned, if at any time the reservoir becomes empty,
<br />the entire river in Colorado reverts back to the administrative decree
<br />system. There is a provision in the compact which assists in the 01'"
<br />eration of making those changes back and forth when those conditions
<br />take place, ,',;,
<br />, Personally, I would like to say that knowing the long history of
<br />litigation and real bad feeling that existed for years between Colorado
<br />and Kansas over this water, that we, who are on the Commission,
<br />feel that we have accomplished a great deal in being able to iron out '.
<br />those troubles and to look at things without prejudice, I want to
<br />compliment at this time the commissioners from Kansas on the fair,
<br />friendly attitude that they took, in spite of some of their water users
<br />who probably felt they were too liberal minded, By the same token
<br />I know that some of our users felt that possibly We were too liberal in
<br />some things, But those are the things that you ,have to do when'you
<br />give and take in making a compact,
<br />We feel we made the best compact that can be made, and that it
<br />will end up in a great improvement in the operation .of this river in
<br />both States,
<br />The CHAIRMAN. This provision by which you have suspended the
<br />operation of priorities so that the stored waters may be used to the
<br />maxinlum, as I get it, is a new principle, is it not ~
<br />Mr, IRELAND, It is, and it is based upon contract among the waUr
<br />users, because it is not in conformity with our State law, It has
<br />been for several years now operated under agreement between the
<br />water users and the compact specifically provides for continuation of
<br />such agreement.
<br />The CHAIRMAN, So long as there is water in the reservoir that may
<br />be released, which vrotects the demand below the reservoir, nobody
<br />below the reservoir IS injured I
<br />Mr, IRELAND, Correct,
<br />The CHAIRMAN, But if the water supply in the reservoir should
<br />run low and these old priorities could not be served, then the other
<br />system is revived? '
