<br />.. <br /> <br />I PURPOSE AND AUTHORITY <br /> <br />o <br />~ (A) Purp9se <br />101:>. <br />en These water quality standards serve the dual function of <br />establishing water quality goals for water bodies of the <br />Southern'Ute Indian Reservation and providing the legal <br />basis for regulatory pollution controls. Establishing <br />criteria,and designated uses that provide for full <br />protection of threatened and endangered species is also an <br />important objective of these standards. <br /> <br />(B) Authority <br /> <br />These water quality standards are adopted by the Southern Ute <br />Tribal Co~ncil under authority established by the Southern Ute <br />Tribal Constitution; Article VIII, Section 1, to protect and <br />preserve the property, wildlife, and natural resources of the <br />Tribe, and to protect the health and welfare of the Southern <br />Ute Indian People. These water quality standards are to be used <br />for all purposes of water quality standards under the Federal <br />Clean Wat~r Act consistent with CWA ~ 518(e) and ~ 303(c). <br /> <br />(1 ) <br /> <br />Asseasment. A primary purpose of these water quality <br />stanards is to guide and inform efforts to monitor and <br />assess surface water quality within the Reservation. <br />These water quality standards playa central role in the <br />Tribe's water quality protection program, and have broad <br />application a~d use in evaluating potential impacts on <br />water quality from a broad range of causes and sources. <br /> <br />(2) <br /> <br />Regulatory Controls. For both point and nonpoint <br />sourqes, any regulatory pollution controls established <br />by the Tribe or the Federal Government must be developed <br />to ensure a level of water quality that will satisfy <br />these water quality standards. Regulatory pollution <br />contrpls established for point sources shall be <br />consistent with applicable portions of the federal Clean <br />Water Act. Tribal programs to control nonpoint sources, <br />wheth'er they be regulatory or voluntary, or both, shall <br />be designed to achieve these water quality standards. <br /> <br />Prote~tion of Threatened and Endan~ered Sbecies.
