<br />. <br /> <br />, <br /> <br />. <br /> <br />REPAYMENT <br /> <br />The Reclamation Act of 1902, together with supplemental <br /> <br /> <br />laws passed in succeeding years, constitute the Reclam3tion Law. <br /> <br /> <br />Provisions particularly applicable to the Mancos Project include: <br /> <br />(a) Delivery of water from works constructed by the <br /> <br />United States must be preceded by a contract with a district <br /> <br />organized under State Law, obligating the District to operate <br /> <br />and maintain the project and to repay the cost thereof, without <br /> <br />interest, in a term not exceeding 40 years. <br /> <br />(b) Water from the works so constructed may not be delivered <br /> <br />to mOre than 160 acres of irrigable land under a single ownership. <br /> <br />(c) No project shall be approved fc'r ccnstructicn until the <br /> <br />Secretary of the Interior shall have made a finding that it is <br /> <br />feasible, that it is adapted for actual settlement and farm homes, <br /> <br />and that it will probably return the cost of its building to the <br />United States. <br />In practice the repayment contract must be executed <br /> <br />before construction is started. The ReclamaticJn Law reouires <br /> <br />joint liability fer all land owners so that repayment will be <br />assured in spite of default of some individuals. <br /> <br />It has been held in the case of the Pine River Project, <br /> <br />Colorado, that organization of a district under the 1935 Conservancy <br /> <br />"~ <br /> <br />37 <br /> <br />2301 <br />
