<br />. <br /> <br />I. <br />~., <br />. <br /> <br />. <br /> <br />11.. ~~. <br /> <br />intended by the parties to this Stipulation that the Districts <br /> <br /> <br />be involved as participants in th~ consultation process by the <br /> <br />aforementioned measures. <br /> <br />Interior agrees that it will fully consider the in- <br /> <br />formation supplied by the Districts and will provide the <br />Project sponsor upon request with a copy of any formal draft <br />biological opinions. Interior further agrees that it will per- <br />mit the Project sponsor an opportunity to discuss factual con- <br />tents of such drafts and to provide further factual information <br />before Interior completes a final biological opinion for sub- <br />mission to the action agency. During the process of development <br /> <br />of any necessary reasonable "and prudent alternatives, Interior <br /> <br />.and the Project sponsor agree to work together in a good faith <br /> <br />effort to develop, if possible, a plan (involving design, con- <br /> <br />struction, and Project operation), which would permit construc- <br /> <br />tion and operation of the Projects consistent with the require- <br /> <br />ments of the Act. <br /> <br />4. Nothing in this Stipulation of Settlement shall <br />affect any rights or responsibilities of the parties that may <br />be created by Section 7(a)(3) of the Endangered Species Act, as <br /> <br />amended, or any regulations promulgated thereunder. <br /> <br />5. Interior agrees that it will provide notice before <br /> <br />it introduces any federally listed threatened or endangered <br /> <br />species into any Project area. <br /> <br />6. With respect to any plants, fish or wildlife that <br />may be found within the Project impact areas and which may be <br /> <br />- 3 - <br />
