<br />dated October 9, 1979, the conditional water right was dedicated and committed <br /> <br /> <br />to be utilized for the Closed Basin Division, San Luis Valley Project, Colorado. <br /> <br />In Colorado Water Court, Case No. 85CW78, RGWCD obtained a conditional <br />underground water storage right, together with 22 points of recharge, encom- <br />passing the Project area of the Closed Basin Project, for purposes of recharging <br />unappropriated surface flows to the 9roundwater aquifer, with an appropriation <br /> <br />date of July 16, 1985, and decree date of December 22, 1987. <br /> <br />RGWCD has also requested the Colorado Water Court to award it a water <br /> <br /> <br />storage right in San Luis Lake to permit it to use that facility for the storage <br /> <br />of water in conjunction with the operation of the Closed Basin Project. The <br /> <br />decree is sought in Case No. 87CW14, with a claimed appropriation date of <br />November 25, 1986. <br /> <br />B. Mitigation Water Rights <br /> <br />The total maximum water that may be del ivered annually for project <br /> <br /> <br />mitigation is 5,300 acre-feet of salvaged water and 1,107 acre-feet from trans- <br /> <br />ferred water rights. When all five project stages have been completed and are <br /> <br />operating, any reduction in project production results in a pro rata reduction in <br /> <br /> <br />mitigation obligation from salvaged supplies. Salvaged water used for mitiga- <br /> <br /> <br />tion will be obtained from water pumped for project purposes through rights <br /> <br />granted to RGWCD by the State of Colorado. Transferred water rights are those <br /> <br />obtained through acquisition of lands and associated water rights acquired for <br />project purposes. Alamosa NWR will receive a maximum 4,500 acre-feet from <br />salvaged water and about 800 acre-feet from transferred water rights.
