Arkansas Valley Conduit Capacity - The Pueblo Dam south outlet works capacity is 359 <br />cfs, which includes 30.94 cfs for the Arkansas Valley Conduit, 278.50 cfs for the Pueblo <br />Board of Water Works, 30.60 cfs for the Fountain Valley Authority, and under separate <br />authority, 18.94 cfs for the Pueblo West Metropolitan District. The Arkansas Valley <br />Conduit was an original element of the Fry-Ark Project as authorized by Congress, and is <br />currently undergoing feasibility studies. Therefore, any re-operation of storage in Pueblo <br />Reservoir must protect the integrity of the delivery capacity from the dam that would <br />supply the conduit. New uses of the south outlet works would have to assure that <br />capacity for the Arkansas Valley Conduit is not compromised. <br /> <br />2. Flow Management Program - Re-operations contract holders agree to participate in a <br />cooperative flow management program designed to achieve a 100 cfs target minimum <br />flow on the Arkansas River immediately below Pueblo Dam. <br /> <br />3. Long-Term Water Quality Monitoring Program - Participating enl1l1es in either re- <br />operations or the enlargement projects will be required to participate in a long-term, <br />water-quality monitoring program. This program includes a "water quality management <br />program," which will be implemented if water quality degrades to a level defined as <br />significant (based upon specific conductance as an indicator parameter). The significant <br />threshold level will be determined by the Implementation Committee's Water Quality <br />Sub-committee in consultation with the United States Geological Survey (USGS). The <br />purpose of the "water quality management program" is to address water quality concerns <br />through the implementation of "best management practices" or other appropriate <br />measures in a manner consistent with applicable water supply needs and water quality <br />requirements. The long-term water quality monitoring program will be implemented via a <br />joint funding agreement with the United States Geological Survey (USGS) and the <br />District's Enterprise. The funding obligation for this program will begin in January 2002. <br /> <br />4. Winter Water Spill Credit- Re-operations contract holders agree to fund the Winter <br />Water Spill Credit as described below. <br /> <br />2.3 Winter Water Spill Credit <br /> <br />The Winter Water Spill Credit is a financial credit for Winter Water spilled and is equal to <br />the storage fees paid by each entity. The Winter Water Spill Credit will only be available <br />after Reclamation has authorized re-operations of Fryingpan-Arkansas Project facilities and a <br />re-operations contract has been executed with an eligible entity. <br /> <br />The Winter Water Spill Credit would apply to spills of Winter Water stored in Pueblo <br />Reservoir by the Direct Flow Applicants of the Winter Water Storage Program.
