(" <br />.... ~'~ <br /> <br />The Bureau's procedure is to have the contractor obtain a permit <br />from the Colorado Department of Health, Water Quality Control <br />Division, for each construction activity where cischarge of water <br />containing pollutants to a stream, lake or watercourse is <br />anticipated. The contractor will be responsible for complying <br />with all of the conditions of the permit. <br /> <br />Because work requires crossing Fountain Creek and the Arkansas <br />River the Bureau has made a determination that Section ~04 <br />nation-wide permit for utility lines crossing is applicable. TIlis <br />determination has been submitted to the Corps of Engineers for <br />their concurrence. All applicable provisions of the permit will be <br />complied with by the Bureau. <br /> <br />3. Clean Air Act <br /> <br />The Clean Air Act provides for the establishment of air quality <br />standards and adoption of implementation plans by State agencies. <br />The Bureau's contractors are required to comply with applicable <br />provisions of these standards and plans. Environmental Quality <br />Protection paragraphs of construction specifications (see <br />Appendix H of the Final Environmental Statement for the Fryingpan- <br />Arkansas Project, Colorado) include air pollution abatement <br />requirements. <br /> <br />D. Design and Construction <br /> <br />1. Fountain Valley Conduit <br /> <br />The conduit with pumping plants appears to be the most nractical <br />solution from both engineering and environmental standpoints for <br />raising~nd conveying water f~Qm_~he-Arkan~R~ R;v~~-tO_~he_~~~i~8 <br />in the Fountain Valley. Land easements will be required for rost of <br />the conduit construction rather than fee simple title. Fee ~itle <br />will be required only for permanent above ground facilities. Thus, <br />after construction, the land surface can continue to be used for its <br />original purpose and will not interrupt wildlife migrations. <br /> <br />Excavated topsoil from designated areas will be stockpiled and <br />subsequently be replaced over the conduit trench area and revegetated. <br /> <br />The pumping plants will be low profile in design and all ~xposed <br />metal parts will be painted to blend with the surrounding e.rea. All <br />exposed surge, storage and regulating tanks will be architecturally <br />designed and painted to blend with the surrounding scene. <br /> <br />V-s <br />
