Nevius <br />President <br /> <br />---<~- <br /> <br />Attol'ney's Repol't <br />To <br />The Amity Mutual Irrigation Company <br /> <br />To the Stocl<holders oJ <br />The Amity Mutual Irrfgatlon Company. <br /> <br />Another year has again passed and this report to you represents <br />one of the many we have had the privilege to make annually over the <br />years and it is with pride that we submit to you the legal aspects of the <br />company's operation. <br /> <br />DurIng the year last past, your attorneys, as always, handled and <br />passed on various legal matters, mostly or a routine nature and advised <br />your board in connection with same. <br /> <br />As you all know by the last aru1Ual report, the Amit,y has, along <br />with other interested parties, all represented by Glenn Saunders, Attorney <br />from Denver t been involved in certain proceedings to stop the Oxford <br />Farmers Canal and Hlghllne Canal lrom diverting water into their <br />irrigation system by the use of adjacent wells. Since this controversy <br />arose, the 1965 legislature has of course passed new legislation which gives <br />the state Engineer speclllc authorit,y to regulate un..rground tributary <br />water the same as surface water according to priority. So the above <br />controversy is, at least for the present time dormant. <br /> <br />From our last report you will recall we reported to you in our report <br />for the year 1965 that we 'Were involved ih a law suit arising out of.. the <br />fiood of. June 1965. The details of. that suit were set out in that report <br />and will not be repeated here lor the sake oJ brevit,y. This suit is .Wl <br />pending In the District Court in Bent County and there has been no <br />significant action in cOMection therewith since our 1965 annual report. <br />It is not knvWlt at this time MIen this suit will be brought to trial on Its <br />merits. <br /> <br />Page 7 <br />
