1061

in July when headgate requirements are highest, and 3,640 ac-ft more than ave-
rage July requirements.

From the foregoing it is believed that the following facts are evident:

1. The 1867 decree for 13.4 cfs for the Oxford Farmers Ditch
for all practical purposes is available continuously, but
is completely inadequate to irrigate the 6,000 acres of land
served by the ditch.

2. The 1887 decree for ll6 cfs, although normally available
only 10% of the time, provides more water than can be put
to beneficial use when it is available.

3. For optimum crop production a better regulated supply is
needed in most years, and an augmented supply is needed
in nearly all years.

4. In the past supplies have been both regulated and augmented
by the use of company-owned and privately-owned wells.

For many years the shareholders under the ditch have grown satis-
factory crops with no major problems except in extremely critical years. They
have used surface supplies to the extent available under rights held by the
Company and ground water from wells when needed to supplement the surface sup-
plies. However, the wells have been operated illegally since they have not
yet been included in the priority system and thus have no recognized legal
water rights.

- 21 -
