<br />3443 <br /> <br />The Cities believe the project conforms to Eagle County's planning <br />policies. <br /> <br />(iv) Specify Whether The Proposed Project Conforms To <br />Regional And State Planning Policies. <br /> <br />The Regional Planning Policies contained in the Northwest Council of <br />Governments 208 Plan have not been adopted by the State and are currently <br />under litigation. Nevertheless, a review of the twelve policies contained <br />in the Revised December, 1981 draft leads to the conclusion that this <br />project conforms to those policies. Furthermore, comments from the <br />NWCOG during the U. S. Forest Service public comment period on the DEIS <br />did not reveal any inconsistencies with the plan. <br /> <br />There are at present no State plans relating to transmountain diversion, <br />nor does the State have any formal state-wide water policies other than <br />State water law and the rights of appropriators provided by law. <br /> <br />(v) Specify Whether The Proposed Project Conforms To <br />Federal Land Management Policies. <br /> <br />The proposed development of the Homestake Phase II Project conforms to <br />Federal land management policies as determined by the U.S. Forest Service <br />position stated in the Draft Environmental Impact Statement (Attachment <br />1), and the exemption allowing the project to go forward contained in <br />the Wilderness legislation which created the Holy Cross Wilderness Area. <br />Any rights-of-way granted by the Forest Service will contain such condi- <br />tions necessary to assure such conformance to Forest Service require- <br />ments. <br /> <br />(vi) Describe The Present Use Of The Lands In This <br />Development Area And Source Development Area. <br /> <br />The present use of the lands in the source development area is National <br />Forest Land, which is primarily designated as wilderness with a Congressional <br />exemption specifically allowing the construction of the Homestake Phase <br />II Project. (P.L. 96-560) Because of the exemption, the project is to <br />be deemed as sebject to usual multiple use management practices. <br /> <br />The development areas, as can be seen from Attachments 7 and 8, are <br />primarily urbanized areas. <br /> <br />(vii) Detail The Present Zoning Of The Land In <br />The Development Area And Source Development Area. <br /> <br />The source development area is zoned as resource lands. <br /> <br />The zoning of lands in the development area are conventional zoning <br />uses. These can be found in Attachments 7 and 8 which are the comprehen- <br />sive planning documents for Colorado Springs and Aurora respectively. <br /> <br />14 <br />
