<br />23GS <br /> <br />. <br /> <br />requirements set forth in the Manual "Construction <br />Salety Standards"; \5\ Designate a competent <br />supervisory employee to carry out the contractor's <br />accident prevention program; and (6) Arrange for first <br />aid training and insure that e\lery supervisor of <br />workmen is a holder of a current Bureau of Mines or <br />American Red Cross first aid certificate-this <br />f~q\l\,.ement may be wai\leO by written consent of the <br />authorized representative of the contracting officer <br />where the nature of the operation or length of contract <br />would make adherence to the provisions impractical. <br /> <br />~ <br /> <br />. <br /> <br />I f the contractor fails or refuses to comply promptly <br />with the above safew requ\remen'ts, \ndud\ng the <br />provisions of the publication "Construction Safety <br />Standards," the contracting officer or his authorized <br />representative shall notify the contractor of the <br />noncompliance and indicate the action to be taken. <br />The contractor or his representative shall, following <br />receipt of such notice at the site 01 the work, <br />immediately correct the conditions to which attention <br />has been directed. Such notice, either oral or written, <br />when served on the contractor or h is representative at <br />the site of the work shall be deemed sufficient. <br /> <br />. <br /> <br />In the event the contractor fails or refuses to promptly <br />comply with the safety directive, the contracting <br />officer may issue an order to suspend a/l or any part of <br />the work. When satisfactory corrective action is taken, <br />an order to resume work will be issued. The contractor <br />shall not be entitled to any extension of time, nor to <br />any claim for damage or to excess costs by reason of <br />either the directive Of the suspension order. Failure of <br />the contracting officer or his representative to order <br />discontinuance of any or all of the contractor's <br />operations shall not relieve the contractor of his <br />responsibility for the safety of personnel and property. <br /> <br />The contractor shall maintain an accurate record of, <br />and shall report to the contracting officer in the <br />manner, and on the forms prescribed by the <br />contracting officer, all cases of death, occupational <br />diseases or traumatic injury arising out of or in the <br />course of employment incident to performance of <br />work under this contract. <br /> <br />. <br /> <br />The contractor shall indemnify and hold the <br />Government harmless for any and all losses, damages, <br />or liability on account of personal injury, death, or <br />property damage, or claims for personal injury, death, <br />or property damage of any nature whatsoever and by <br />whomsoever made, arising out of the activities of the <br />contractor, his employees, subcontractors, or agents <br />under the contract. Such indemnity snan inc\ude, but <br />shall not be limited to, the failure of the contractor, his <br /> <br />to <br /> <br />. <br /> <br />employees, subcontractors, or agents to comply with <br />the safety requirements contained in these <br />specifications. <br /> <br />3 <br />
