(a) The Bureau of Reclamation and the Deparbnent of the Interior <br />are committed to completion of the Project. The State of Colorado agrees herein <br />to cost-share one-third of the costs in excess of $75,000,000 or $6,000,000, <br />whichever is less, as specified in section 109 of the authorizing legislation, <br />It is agreed by the parties that the State's contributive funds will be applied <br />upon the award of a contract for the construction of Stage 5 laterals. <br /> <br />(b) Within 30 days after the award of a contract for construction <br />of Stage 5 laterals, the United States Shall notify the State in writing that <br />such event has occurred. Within 45 days after receipt of such notice by the <br />State, the State shall pay to the United States one-third of the construction <br />costs, including administrative costs, which have been incurred in excess of <br />$75,000,000 through the end of the quarter immediately preceding the occurrence <br />of the said event. <br /> <br />(c) After making the one time payment pursuant to subarticle (h) <br />herein, the State shall make further payments to the United States as <br />follows: <br /> <br />(1) For the quarter immediately following the quarter <br />through which payment is made pursuant to subarticle (b) hereof, the State shall <br />pay to the United States, within 45 days of receipt of the. notice, one.third of <br />the projected construction costs, including administrative costs, which the <br />United States has estimated pursuant to Article S(a) herein, will be incurred <br />in that quarter. <br /> <br />(2) For each quarter thereafter, the State shall pay to the <br />United States, within 45 days of the first day of a quarter, one-third of the <br />construction costs, including administrative costs, which the United States has <br />estimated pursuant to Article 5(a> herein will be incurred during a quarter, <br />minus such credits or plus such debits as required to account for over or under <br />payment by the State to the United States" relative to costs actually Incurred <br />during such quarter as reflected in the statements provided pursuant to Article <br />5(/~) . <br />(d) The United, States understands and agrees that the State's <br />obligation to make payments to the United States pursuant to this Article 6 is <br />limited to one-third of the construction costs, including administrative costs, <br />in excess of $75,000,000 or to $6,000,000, whichever is less. The United States <br />further understands and agrees that it is obligated to complete the entire <br />Project, subject to the availability of Congressional appropriations and the <br />$94,000,000 appropriations ceiling in section 109 of the authorizing legisla- <br />tion, even if the State's limit of $6,000,000 is reached and no further monies <br />are forthcoming from the State. <br /> <br />(e) Monies paid by the State to the United States pursuant to <br />this Article 6 shall be non-reimbursable. <br /> <br />(f) Within 60 days of completion of construction of the <br />entire Project, the United States shall provide to the State a complete and <br />final accounting of total construction costs, including administrative <br />costs, which final accounting shall detai 1 and itemize all costs incurred, <br />identify expenditures of federal monies by the United States in excess of <br />$75,000,000, and identify the receipt and expenditure of State monies. <br /> <br />4 <br />"" <br />
