The Committee recommends the following:

H.8. 1158 be amended as follows, and as so amended, be
referred to the Committee on Appropriations with
favorable recommendation:

1 Amend printed bill, strike everything below the enacting
2 clause, and substitute the following:

3 "SECTION 1. 37-60-106 (1), Colorado Revised Statutes, as
4 amended, is amended BY THE ADDITION OF THE FOLLOWING NEW
5 PARAGRAPHS to read:

6 37-60-106. Duties of the board. (1) (p) To make grants
7 pursuant to the provisions of section 37-60-122.2 (2) for fish
8 and wildlife resources;

9 (q) To make findings pursuant to the provisions of
10 section 37-60-122.2 (1) of the official position of the state
11 of Colorado regarding the mitigation actions required to
12 maintain a balance between the development of the state's
13 water resources and the protection of the state's fish and
14 wildlife resources.

15 SECTION 2. 37-60-121 (6), Colorado Revised Statutes, as
16 amended, is amended, and the said 37-60-121 is further amended
17 BY THE ADDITION OF A NEW SUBSECTION, to read:

18 37-60-121. Colorado water conservation board
19 construction fund - creation of - nature of fund - funds for
20 investi ations - contributions - use for au mentin the
21 general fund. 6 As of July 1, 1988, and July of each
22 year thereafter through July 1, 1990, fifty percent of the sum
23 specified in this subsection (6) shall accrue to the FISH AND
24 WILDLIFE RESOURCES ACCOUNT WHICH ACCOUNT IS HEREBY CREATED IN
25 THE Colorado water conservation board construction fund,
26 TWENTY-FIVE PERCENT OF SUCH SUM SHALL ACCRUE TO THE COLORADO
27 WATER CONSERVATION BOARD CONSTRUCTION FUND, and ftfty
28 TWENTY-FIVE percent of such sum shall accrue to the Colorado
29 water resources and power development authority. The state
30 treasurer and the controller shall transfer such sum out of

32 aijiR6Ftiy FISH AND WILDLIFE RESOURCES ACCOUNT, CONSTRUCTION
