DACW47-3-69-l57

ntten-::'ion: John R. Cobb, Chief, Real Eztate Division

Dear Colonel Hottonroth:

wo are pleClsed to rocoi,ve the fully ezecuted copies of the 2~-:i(><1r
License for' FiSh ana ~iildlife l1ani'lgE,ment Purposes on the John r-tartin
Dem and Reservoir project. We, too, were pleased in your concurrence
that since our use of the shares of water would be for public pur-
poses there would be no lease charse on these shares of water. The
only payment required \olill be to the irrigation compimy.

since your present out leases for agriculture and grazing purposes
do not e,:pire until February 28, 1971, it would appear desixable
from our standpoint for you to cancel those leases as of February
28, 1970. This would be advantageous to us if it could be done with-
out crcatin9 any undue prOblem. The requirement could even be m<lde
that the State would negotiate a lease with your lessee for a one
year period. This might permit us to use all or part of the watel"
delivered to your shares for the perm~nent pool as early as the spring
and SWfu~er of 1970., After the shares of water are under our control,
we, doubtless, will have to have a Court Adjudication permitting us to
change use and to change the point of diversion.

Sincerely,

Harry R.
