Since <br />there was no opposition voiced to the <br />formation It was approved on July 6, <br />1970. by the presiding judge. Donald <br />Carpenter. <br />Upon approval. the Subdistrict <br />became a political subdivision of the <br />State of Colorado and a separate and <br />independent conservancy district with <br />the same powers and legal standing <br />as the parent district. <br /> <br />The Subdistnct was formed for the <br />purpose of developing a new and <br />independent water supply for the use <br />of the Six Cities or their subsequent <br />assignees. <br /> <br />6 <br /> <br />The Board of Directors of the <br />Subdlstnct IS. by statute. the same as <br />the District. though the Subdistrict <br />elects a different slate 01 officers than <br />those chosen for the District. These <br />two agenCIes are neadquartered In the <br />same office in Loveland. and share <br />many of the same staff and equipment. <br /> <br />Benefits - CreallOn of the Subdls- <br />tnct enabled work to begin on the <br />development of the Windy Gap Project <br />to bring the excess floodwaters from <br />the Fraser River to the rapidly growing <br />Front Range. <br />After its formation. the Subdistrict <br />negotiated a contract with the USSR <br />and the NCWCD In order to use the <br />existing C-8Tfacilities to transport and <br />distnbute the water to the cIties on the <br />eastern slope. This was essenliallythe <br />first slep in the development 01 Windy <br />Gap as the Project could not have <br />been developed on an economIc basis <br />Without relYing upon the use of the <br />storage and transportation facilities <br />that already eXisted. <br />As for financing Windy Gap. the <br />Subdistrict proved to be an extremely <br />effective mechanism through which to <br />secure bonding for the Project. <br /> <br />Carriage Contract <br />Immediately after the Subdistrict <br />was established. discussions began <br />between the USSR. the MuniCipal <br />Subdistrict and the NCWCD on the <br />proposed carriage contract. This <br />contract permits the Subdistrict to use <br />the excess diverSion and storage <br />capacity Within the already existing <br />C-ST Project system. <br />The carnage contract. which <br />generally specifies how Windy Gap <br />water will be transferred to the eastern <br /> <br />
