C. 20240 <br /> <br />Dear Mr. Secretary: <br /> <br />We have studied carefully the tentative conclusions of your Asso- <br />ciate Solicitor lvhich 1\1ere transmitted with your letter of Sept- <br />ember 24, 1969, and which concern non-federal-project use of ir- <br />rigation water from the Missouri River. <br /> <br />Where and when applicable, the Missouri Basin states people do not <br />disagree with the conclusions of your Associate Solicitor. HO\'.Jever, <br />we do not agree that these conclusions are applicable in the instance <br />of private irrigation use of water from the Missouri River, irrespec- <br />tive of where such use occurs in states wholly or partly west of the <br />98th meridian. Our beliefs are set forth in the attached general <br />position statement, which is transmitted on behalf of the affected <br />Missouri Basin states and to assist the discussions during the meeting <br />scheduled for January 28-29, 1970, Room 7403, U. S. Post Office and <br />Court Holtse, Omaha, Nebraska. <br /> <br />States people believe that fruitful results from this meeting are more <br />likely if policy and project formulation experts from your office <br />participate in addition to the legal counsel of your Mr. Morthland.
