<br />o <br /> <br />,...- <br /> <br />-'. <br />, . <br />- <br /> <br />.-5--1 <br /> <br />(l) Between December 1, and February 15, each <br />state shall have unrestrioted use of the water which <br />may flow within its boundaries. <br /> <br />(2) Between February 15 and December l. <br /> <br />(a) Each state shall have the unrestricted <br />use of the water within its boundaries on each day <br />the mean flow at the interstate station (within <br />one mile of the state line) shall be 100 second- <br />feet or more, but <br /> <br />(b) Vfuen the f10~ at the interstate station <br />is less than 100 second-feet, Colorado shall deliver <br />at the interstate station a quantity of water <br />equivalent to one-half of the flow at the Hesperus <br />Station (reoorded flow at Hesperus plus concurrent <br />diversions by ditches diverting above Hesperus) <br />on the previOUS day, but not to exceed 100 second- <br />feet. <br /> <br />'/ ... <br /> <br />(3) At times of low flow the state.engineers may,agree to <br />rotate the entire flow to eaoh state. <br /> <br />-' <br /> <br />(4) Use by New Mexico is at all times limited to the <br />requirements of beneficial use. Operation of the Compact <br />has shown that when the flow at Hesperus falls to 25 <br />second-feet, such flows, if allowed to pass, would not <br />reach the state line and consequently would not benefit <br />New Mexico. Colorado ditches having senior rights, all <br />above Fort Lewis, have, therefore, been permitted to <br />divert all flows at HeSperus of 25 second-feet or less. <br />At the same time Colorado ditches below the mouth of <br />Cherry Creek, including the ditches fed by seepage from <br />Long HOllow Creek, have been required to cease diversions. <br />This practice, established by 15 years of operation, has <br />rendered clause 2 (b) of the Compact inoperative in the <br />latter part of the irrigation season so that none of the <br />flow at Hesperus need be turned down at such times. <br /> <br />Available Water Supply <br /> <br />No water is imported to the La Plata River drainage basin <br /> <br />29 <br />
