<br /> <br />c,':) <br />o <br />("':''l <br />.;;.. <br />I-'" <br />W <br /> <br />. <br /> <br />. <br /> <br />a) The amount or extent of take specified in the incidental take statement in <br />biological opinions is exceeded. <br /> <br />b) New information reveals effects of the action that may affect listed species or <br />critical habitat in a manner or to an extent not previously considered. <br /> <br />c) A project (identified action) is subsequently modified in a manner that causes <br />an effect to a listed species or critical habitat that was not previously <br />considered. <br /> <br />d) The Service lists new species or designates new or additional critical habitat <br />that may be affected. <br /> <br />lfthe Service determines that reinitiation of consultation on water projects may be necessary <br />for any reason, it will provide such information to the Federal action agency, the project <br />sponsors, and to the Coordination Committee. RIP participants will participate infinding <br />solutions to the problem which could trigger the reinitiation of consultations. Only if the RIP <br />cannot implement recovery actions to remove the cause of reinitiation will the Service <br />reinitiate consultation on individual water projects and/or require project sponsors to provide <br />reasonable and prudent alternatives. <br /> <br />With respect to the specific reasons listed above, should the Service find cause for reinitiation, <br />the following courses of action will be taken: <br /> <br />a) The amount or extent oftake slJecified in the incidental take statement in biolof!ical <br />olJinions is exceeded. If consultation is reinitiated because the incidental take limit has <br />been exceeded, and additional reasonable and prudent measures are needed, the <br />Service will identify the actions needed, and provide the RIP with the opportunity to <br />incorporate those actions into the long range plan and implement those actions. <br /> <br />b) New information reveals effects of the action that mav affect listed slJecies or <br />critical habitat in a manner or to an extent not IJreviouslv considered. New <br />information includes significant declines in population, as determined through the <br />monitoring programs, and those declines are determined to be due to water <br />development or management activities. The Service retains the authority to determine <br />whether a significant decline in population has occurred, but will consult with the <br />Recovery Program prior to making its determination. In the event of a significant <br />population decline due to water development or management activities, the Service will <br />first rely on the RIP to take actions to correct the decline. Only if the RIP cannot take <br />the actions to correct to decline will the Service reinitiate consultations on water <br />projects that have relied upon the RIP to provide reasonable and prudent alternatives. <br /> <br />New information may include the fact that the long range plan elements used as <br />reasonable and prudent alternatives are not implemented in the required time frames. <br />The required timeframes will include changes in timing approved by means of the <br />normal procedures of the RIP.
