Supreme Court in 1927 by the <br /> <br />State of Colorado against the state of Kansas and still pending <br /> <br />is expected to effect an equitable division of waters originating <br /> <br />in the Arkansas River Basin. A decision in this case would define <br /> <br />the rights of individual ditcheS of Kansas to enjoin Colorado <br /> <br />ditches in the use of water. The Fl..nney County V.ater Users <br /> <br />Association case and the Kohler case are two such suits now pending <br /> <br />in the Federal District Court. In the latter, the rights on <br /> <br />tributaries of the Arkansas River in Colorado are challenged. The <br /> <br />outcome of this action will have considerable bearing upon th,) use <br /> <br />of Purgatoire River flows since this stream is the largest pro- <br /> <br />ducer of unappropriated waters reaching the Arkansas River. <br /> <br />. <br /> <br />Since construction of the John Martin Dam appears assured, it is <br /> <br />likely that these suits "may be disposed by dismissal or stipulated <br /> <br />decrees pursuant to provisions of an interstate compact or agreement. <br /> <br />John Martin (Caddoa) Reservoir <br /> <br />This project, authorized for construction qy the War <br /> <br />Department and actively supported by state and private interests, <br /> <br />is located on the Arkansas River about 12 miles west of Lamar, <br /> <br />Colorado, below the mouth of the Purgatoire. Reservoir capacities <br /> <br />allocated to flood control and water conservation are 270,000 <br /> <br />and 400,000 acre-feet, respectively. A study of the water supply <br /> <br />for this project vms made by Royce J. Tipton, Consulting Engineer, <br /> <br />Denver, ColOrtldo, and released in January 1938 by the Colorado <br /> <br />State Planning Commission and the Colorado iiaterConservation Board. <br /> <br />. <br /> <br />22 <br /> <br />
