(c) Sear all costs of operation, maintenance, and replacement

of recreation and fish and wildlife lands and facilities, presently estimated

at $142,200 on an average annual basis;

(2) Provide the water required for initial filling and replenishment of

evaporation and other losses of the recreation pool by purchase or other

means consistent with Federal and State laws (presently estimated to cost

$1,290,000), to assure effective operation of the project for recreation with

provision that one-half of the cost thereof is eligible for credit against the

non-Federal obligation for assuming one-half the separable costs for recrea-

tion and fish and wildlife enhancement;

(3) Prevent encroachments on the channel of Fountain Creek below the

project and maintain a minimum capacity of 15,000 cubic feet per second;

and

(4) Hold and save the United States free from water rights claims due

to construction and operation of the project.

On the foregoing basis, the net cost to the United States for the recom-

mended improvements is estimated at $38,104,000 for construction and

The Board further recommended that:

a. Following authorization of the Fountain Dam and Lake project, detailed

site investigation and design be made for the purpose of accurately defining the
