<br />. <br /> <br />c <br />'-.W"J <br /> <br />I\j <br />~ <br />c..u <br />f\J <br /> <br />. <br /> <br />e)- <br /> <br />10. <br /> <br />The position of the State ~gineer ~as vigorously attacked qy represen- <br /> <br />tatives of many of the ditches, particularly those above Gaddoa reservoir. <br /> <br />Follo~ing the presentation of the dr&ft of a proposed agreement <br /> <br />to be entered into by the two State Engineers covering tlle administration <br /> <br />of the Stipulation, a resolution was adopted by the Ditch Association to <br /> <br /> <br />the effect} that prior to the signing of any agreement between t he t~o <br /> <br /> <br />State Engineers, the Executive Committee direct counsel for the Associa- <br /> <br />tion to confer with the Attorney General and Stete Engineer concerning <br /> <br />these tvlO important matters, and to report back to the Executive Com- <br /> <br />mittee the result of such conferences, before any agreement between the <br /> <br />two State Engineers was entered into. <br /> <br />On April 28th, I requested an opinion from the Attorney General, <br /> <br />on the following questions: <br /> <br />1. The date on which the Stipulation became effective. <br /> <br />2. The correctness of the State Engineer's interpretation of <br /> <br />the provisions and terms of the Stipulation as regards Colorado's obli- <br /> <br />gat ions to Kansas and proposed methods for meeting same wh9n Caddoa reser- <br />mo.Jfdhe 1 <br />voir !e. empty. <br />^ <br /> <br />5. Tae obligation of the State Engineer to restrict diversions <br /> <br />of ~ater qy Colorado ditches regardless of location, in accordance with <br /> <br />their decreed priorities, if need be, to meet deliv9ries of water to <br /> <br />Kansas, required by the Stipulation. <br /> <br />4.
