Water impounded in Caddoa Reservoir to be considered as <br /> <br />temporarily regulated stream flow and not as "Surplus" water. <br /> <br />2. Diversions by Colorado ditches below Caddoa and deliver- <br /> <br />ies to Kansas are to be maint,,-ined substantially and concurrently in <br /> <br />the ratio of 69.4 percent to Colorado ditches and 50.E percent to Kans"-s <br /> <br />ditches, this being the ratio of 117,900 acre feet to 52,000 acre feet. <br /> <br />5. So long as there is water in Caddoa Reservoir belonging to <br /> <br />Colorado, the same must be used to serve Colorado ditches below the reser-- <br /> <br />voir and to meet required deliveries at the state line and net credits to <br /> <br />Kansas which may be the result of additional or excess diversions by <br /> <br />ditches abcwe Caddo a Reservoir under priorities junior to February 21, <br /> <br />1887 (the Amity's first priority). <br /> <br />4. Diversions by ditches above the reservoir under their <br /> <br />junior decrees, are to be permitted in their relative orders of priority <br /> <br />r.ithout regard to senior priorities below the reservoir 50 long as the <br /> <br />quantity of water in the reservoir belonging to Colorado is sufficient to <br /> <br />meet the daily dem&nds of decrees below the reservoir, provided, hor-ever, <br /> <br />that any diversions by upstream ditches under priorities junior in date <br /> <br />to Februar,r 21, 1887 which, under a strict admirJistration of the river <br /> <br />upon a priority basis would heve been required to meet demands of senior <br /> <br />decrees below Caddoa, shall be considered as properly chargeable to <br />
