<br />o <br />'OJ" <br />\,:'.) <br />.,..., <br />'- :") <br />c:. <br /> <br />COLORADO WATER CONSERVATION SOARD <br />823 State Centennial Building <br />1313 Sherman Street <br />Denver, Colorado 80203 <br /> <br />'if <br /> <br />October 7, 1982 <br /> <br />RES 0 L UTI 0 N <br /> <br />., <br /> <br />WHEREAS, Public Law 92-514, as amended by Public Law 96~375, <br />authorizes the Secretary of the Interior, hereinafter referred to <br />as the "Secretary," to construct, operate, and maintain the <br />Clo.sed Basin Division, San Luis Valley project, Colorado, herein- <br />after referred to as the "project" 1 and <br /> <br />WHEREAS, Section 101 (b) of said public law. provides that:. <br />"Construction of the p;'oject may be undertaken in such units or <br />. stages. as in the determination .of the Secretary will best serve <br />project requirements and meet water needs: . provided, That con- <br />structionof each of the successive units or stages after stage 1 <br />of said project shall be undertaken only with the consent of the <br />Colorado Water Conservation Board and the Rio Grande Water <br />Conservation District '" "rand <br /> <br />WHEREAS, the Secretary, act ing through the U, 8, Bureau of <br />Reclamation, desires to initiate the drilling of salvage wells <br />and the acquisition of land needed for such wells in stage 3 of <br />the project in federal fiscal year 1983 in order that such wells <br />might be pump tested so that data can be obtained for the subse- <br />quent design of pumps and distribution pipes1 and <br /> <br />WHEREAS, all such wells will be capped after test pumping <br />and not placed into production until the Colorado. Water. <br />Conservation Board and the Rio Grande Water Conservation District <br />consent to the same. <br /> <br />NOW THEREFORE, BE IT RESOLVED by the Colorado Water <br />Conservation Board. in regular session assembled at AlaIilosa, <br />COlorado, this 7th' day of October, 1982, that the Board does <br />hereby consent to the drilling of salvage wells and the acquisi- <br />tion of the land needed for such wells in stage 3 of the project <br />so long as: (1) all such wells are capped after being pumped <br />tested and not put into prOduction until the consent of the <br />Colorado Water Conservation Board and the Rio Grande Water <br />Conservation District has been given to place such wells in pro- <br />duction, (2) the project proceeds in substantial conformity with <br />the Definite Plan Report for said project, (3) the U.8. Bureau of <br />Reclamation proceeds with diligence in the construction .of stages <br />1-2 of the project, and (4) construction of such wells is in com- <br />pliance with applicable state law. <br /> <br />129 <br />b/r <br />
