La Plata River Compact - 1922 <br /> <br />At the same time that the Colorado River Compact was negotiated, <br /> <br />Colorado and New Mexico negotiated and executed the La Plata River <br /> <br />Compac t. <br /> <br />This compact provides for the division of the water of the La Plata <br /> <br />River between the two states as follows: <br /> <br />1. Between December 1 and February 15 of the succeeding year, <br />each state shall have unrestricted use of the water of <br />the water of the river flowing within its boundaries. <br /> <br />2. Between February 15 and December 1 of each year, the flow <br />is apportioned as follows: <br /> <br />a. Each state is to be unrestricted in the use of <br />water within its boundaries on each day when the <br />mean flow at the interstate s'tation is 100 cfs of <br />more. <br /> <br />b. On all other days, Colorado is to deliver at the <br />interstate station one-half previous day's flow <br />at Hesp~ru~ ~tHtion but nDt ..-itO're th~.n 1 00 ~f~. <br /> <br />3. In times of low water, the State Engineers of the two <br />states can agree to rotation schedule of use of all <br />water in lieu of the provisions of (2) above. <br /> <br />4. Colorado is not required to deliver any water to <br />New Mexico not then necessary for beneficial use in <br />New Mexico. <br /> <br />D. Animas-La Plata Project Compact <br /> <br />The Animas-La Plata Project Compact has been entered into in order to <br /> <br />clarify the relationship between ColoradQ and New Mexico water users <br /> <br />on the Animas-La Plata Project, authorized by Public Law 90-537. <br /> <br />The Compact makes the priority of the New Mexico water users of <br /> <br />the Animas-La Plata Project water equal to the decreed rights of the <br /> <br />Colorado water users who take water from the same project. <br /> <br />21. <br />
