<br />.' <br /> <br />-f,. tj,"\ v.') <br />_ u '~, L. - <br /> <br />DRAFT <br /> <br />The Compact provides further that, if the United States recognized <br /> <br />any rights by Mexico in the Colorado River, the water would be supplied <br /> <br />from the waters which are surplus to the allocations made to the Upper <br /> <br />and Lower Basins. If this is not sufficient, then the burden of fulfilling <br /> <br />the shortages will be equally borne by the Upper and Lower Basin states. <br /> <br />The Rio Grande, Colorado and Tijuana Treaty of 1954, between the <br /> <br />United States and Mexico, guaranteed delivery of 1,500,000 acre-feet of <br /> <br />water per year to Mexico from the Colorado River. <br /> <br />Recent legislation, specifically Public Law 90-537 (Colorado River <br /> <br />Basin Project Act), approved September 30, 1968, declared that the satis- <br /> <br />faction of the water requirements from the Colorado River to Mexico <br /> <br />constitutes a national obligation of any water augmentation project planned <br /> <br />pursuant to the Act and authorized by the Congress. It relieves both the <br /> <br />Upper ani! Lo'ver Basin from the compact requirement covering deliveri "s of <br /> <br />water to Mexico. This relief is contingent upon the authorization and <br /> <br />operation of a plan to augment the Colorado River water supplies by 2~ <br /> <br />million acre-feet annually. <br /> <br />B. ~ Colorado Riv~r Basin Com~~~ <br /> <br />This compact between the states of Arizona, Colorado, Ne", Mexico, Utah <br /> <br />and Wyoming and the United States Government apportions waters of the <br /> <br />Upper Colorado River Basin which had been alloted to the Upper Basin states <br /> <br />by the Colorado River Compact. <br /> <br />Of the Upper Basin allocation, Arizona ",as allotted 50,000 acre-feet <br /> <br />annually. The remaining states ",ere allocated the follo",ing percentar-es <br /> <br />of the remainder: Colorado - 51.75%, Ne", Mexico - 11.25%, Utah - 23.00% <br /> <br />and Wyoming - 14.00%. <br /> <br />The state of Colorado agreed to deliver ",ater to New Mexico from the <br /> <br />San Juan River and its tributaries in a sufficient quantity to enable <br /> <br />New Mexico to make full use of its allotted share. <br /> <br />20. <br />
