<br />IJ01623 <br />III. Arkansas River Compact, ~7-69-101 CRS, December 14, 1948. <br /> <br />A Purpose and Allocation of 1948 Compact <br /> <br />1. Purposes <br />o settle disputes, remove future controversies. <br />o equitably divide and apportion waters of Arkansas River and benefits of JMR. <br /> <br />2. Waters of Arkansas River - "waters originating in the natural drainage basin of <br />the Arkansas Riverand tributaries above the stateline." Excludes transmountain <br />imports, also excludes small portion of basin in N.M. <br /> <br />3. JMR operated by Corps of Engineers <br />a. flood control above elev. 3851' <br />b. conservation pool to benefit water users above and below reservoir, (upstream <br />benefits by reducing calls from below JMR). <br />c. permanent pool not initially authorized, added in 1970's. <br /> <br />4. Future development not prohibited but "waters of Arkansas River ..... shall not be <br />materially depleted in useable quantity or availability for use to the water users in <br />Colorado or Kansas." Useable quantity refers to volumes within capacity of <br />division works, availability refers to timing during irrigation season. <br />a. No transfers of District 67 rights above JMR. <br />b. No increase "beyond the total present rights in Dist. 67 or Kansas." <br /> <br />5. Apportionment <br />a. All winter flows (November 1 to March 31) are stored, but Colorado may <br />request bypass of up to 100 cfs. <br />b. All summer inflows (April 1 to October 31) are also stored, but bypassed for <br />Kansas of up to 250 and Colorado up to 500 cfs. <br />c. Stored water released after April 1 upon demand of either state. <br />o Kansas can demand rate of up to 500 cfs (40%) measured at stateline. <br />o Colorado at a rate up to 750 cis (60%) measured at JMR dam and <br />distributed to ditches by agreement. <br />d. no carry over, no credits or debits <br />e. no call above JMR while storage releases occurring. <br />f. releases must be promptly applied to beneficial use. <br />g. When storage water exhausted: Colorado ditches above and below JMR <br />administered in priority. Kansas not entitled to any share of inflow to JMR, <br />but can take whatever return flows cross state line. <br /> <br />B.
