<br />adopted 20 March 1945, requested a review of the project document <br />to determine whether any modification of the recommendation contained <br />therein could be made to provide flood protection for Trinidad and, <br />at the same time, make more water readily available for agricultural <br /> <br /> <br />and industrial uses. On 30 June 1953, the Albuquerque District sub- <br /> <br /> <br />mitted a report recommending the construction of a dam and reservoir <br /> <br /> <br />project for flood control and irrigation in lieu of the previously <br /> <br /> <br />recommended floodway (published as House Document No. 325, 84th <br /> <br /> <br />Congress). Industrial water supply is not currently a project purpose. <br />This recommended project was subsequently authorized with the provision <br />that authorization of the floodway would not be rescinded until construc- <br />tion of the dam and reservoir was initiated. The city of Trinidad <br /> <br /> <br />was relieved from making a cash contribution of 4.5 percent of the <br /> <br /> <br />first cost allocated to flood control by the Flood Control Act of 1965, <br /> <br /> <br />Public Law 89-298, approved 27 October 1965. This contribution has <br /> <br /> <br />reverted to Federal (Corps of Engineers) cost. However, in lieu of <br /> <br /> <br />this local cooperation, the city is responsible for maintaining a <br /> <br /> <br />15,000 cubic-feet-per-second channel through town. <br /> <br /> <br />The basic legislation relating to the development of reservoir <br /> <br /> <br />areas under the control of the Department of the Army for recreational <br /> <br /> <br />purposes is contained in Section 4 of the Flood Control Act approved <br /> <br /> <br />22 December 1944 (Public Law 534, 78th Congress, 2d Session) ss amended <br /> <br /> <br />by Section 207 of the Flood Control Act of 1962, as further amended <br /> <br /> <br />by Section 2 of the Land and Water Conservation Fund Act of 1965. The <br /> <br /> <br />amended Section 207 provides authority for the Chief of Engineers under <br /> <br /> <br />the supervision of the Secretary of the Army, to construct, maintain, <br /> <br />1-2 <br /> <br />. <br /> <br />. <br />
