<br />. . "This compact is not i-nteilded to' impede or prevent future -beneficial develop.
<br />ment of the Arkansas River basin in. ColQrado, and Kansas by Federal or
<br />State agencies, D~t private enterprise, or by combinations thereof, which may
<br />involve construction of dams, l'ese;-voirs, and other works for the purposes of
<br />water utilization and control, as well as the improved or prolonged fuhctioning
<br />of existing works: Provideu~. That the waters of the Arkansas River, as defined
<br />in Article Ill, shallllot be materially depleted in usable quantity or availability
<br />for use to the water users in Colorado and Kansas under this Compact by such
<br />future development or construction:"
<br />The above language was evolved from extensive consultation with the affected
<br />Federal agencies. It is intended to leave the door open-as it should be-for
<br />beneficial .development of the ArkaJ,lsas- River basin in Colorado and Kansas
<br />by any and all pl'oper ways and means. But such development, whatever form
<br />it may take, must fit into the framework of the proposed compact; it must
<br />ilot disrupt the relationships nnd rights established thereunder and must not
<br />affect advel'Sely the interests of the States. and their water users under the
<br />compact. Without these safeguards, the interstate controversy would soon be
<br />l'evived and the proposed compact would be wasted effort.
<br />It is to be presumed that 'Federal agencies will respect the above provisions
<br />fiR fI matter of ('0111'8(> in th(>1r development plans for the Arkansas River basin,
<br />It is also presumed by the COlppact negotiators that when such plans are'submitted
<br />to the Governors of the affected States, pursuant ,to the provisions of th,e Flood
<br />Control Act of December 22, 1944, the Governors of COlorado and Kansas will
<br />be especially mindful of the protective provisions of article IV-D in formulating
<br />their' official views and recommendations. .
<br />SECTION 10. 'ODUGATIONS OF THE UNITED STATES
<br />The speCific obligations that will rest.-upon the United States if and when the
<br />proposed compact becomes effective are as follows ':
<br />(l1.l) Operation of John Martin Reservoir by the Corps of Engineers in con-
<br />sonance with articles IV aud V.
<br />(b) Appointment, at the discretion of the President, of a representative of
<br />the United States as an ex officio member and chairman of the interstate admin~
<br />istrative agency to be established under article VIII, and payment of compeusa.
<br />tion and expenses of such representative if one be appointed.
<br />(0) Oooperation and coUaboration on the part of Federal ageucies=:'-viz,
<br />Geological Survey, Bureau of Reclamation, aud Corps of Engineers-in stream
<br />gaging, sUt surveys, llnd other functions related to administration under articl.e
<br />VIII.
<br />The Federal expenditures incident to these obligations will be quite small and
<br />certainly not inconsistent with the importance of the Federal interests concerned
<br />with th.e administration of the proposed compact.

<br />
<br />My over-all appraisal of the proposed compact warrants the firm conclusion
<br />that it Is a fair, constructive, and workable solution to the Colorado.Kausas con-
<br />troversy while fully protect1ng.~tbe interests. of,the Uni~ iS~atel':l in the waters of
<br />the Al'lmnsas River. To make'the p~oposed compact'ef'fec.tive, I.recommend'_un-
<br />qualifiedly that it be consented to by the Congress of the United States- by appro.
<br />priate legislation embracing the provisions of article IX-A.
