<br />AN ACT Approving the Arkansas River Compact Between the State of Colorado and the
<br />State of Kansas: Affecting the Arkansas River, Its 'l'rlbutaries and the Waters of Said
<br />River and Its Tributaries j and providing for th.e Operation and Implementation of Said
<br />Compact
<br />
<br />Be it enaoted by the Gene1'a~ A88emb'ty of the State of Oo~orado:
<br />
<br />SEOTION 1. The General Assembly hereby ratifies the Compact between the
<br />State of Colorado and the State of Kansas designated as the "Arkansas River
<br />Compact" signed in the City of Denver, State of -Colorado, on the 14th day of
<br />December A. D. 1948, by Henry C. Vidal, Gail L. Ireland, and Harry B. Menden-
<br />hall, Oommissioners for the State of Oolorado, and George S. Knapp, Edward
<br />F. Arn, William E. Leavitt, aDd Roland H. Tate, Commissioners for the State
<br />of Kansas, and approved by Hans Kramer, Representative of the United States
<br />of America. Said compact is as folloWJ3: Text of compact included in H. R.
<br />4151 prInted on preceding pages.
<br />SEOTION 2. Said compact shall not become effective unless and until the same
<br />shall have been ratified by the legiSlature of each of the signatory states and
<br />consented to by the Congress of the United States of America. "The Governor
<br />of the State of Colorado shall give notice of the ratification of the said compact by
<br />this act to the Governor of the State of Kansas and to the President of the United
<br />States of America.
<br />SEOTION 3. It is hereby recognize.d, found, determined, and declared that the
<br />compact creates an interstate agency which is known as the Arkansas River
<br />Compact Administration aDd which is un independent entity whose members and
<br />employees are not ofilcers and employees of either of the States signatOl'y to the
<br />compact. .
<br />SEO'l'ION 4. After the said compact becomes effective the Colorado members of
<br />the Arkansas River Compact Administration shall be appointed by the Governor,
<br />Bhall serve uuUll'evocntioll Qf their -appoIntment by the Governor, and, on behalf
<br />of the Arkansas Rivet' Compact Administration, the State of Colorado shall pay
<br />the necessary expenses and also compensation of said members in an amount
<br />which shall be flxed by the Governor and when so fixed shall be change,d only by
<br />action of the Governor.
<br />SEOTION 5. The Colorado share of the expenses of the Arkansas River Compact
<br />Administration and the expenses and compensation of the Colorado members
<br />of that Administratlofl shall be paid out of funds now or hereafter appropriated
<br />by the General Assembly to the Colorado Water Conservation Board and war-
<br />rants shall be drawn against such appropriation upon vouchers signed by the
<br />Governor and the Director of the Colorado Water Oonservation Board.
<br />SEOTION 6. The prOVisions of the Administrative Oode of 1941 (Ohapter 2,
<br />Colorado Session Laws, 1941) and all acts amendatory or supplementary thereto
<br />shall be inapplicable to any ncts or prQceedings taken to carry out the purposes
<br />of said compact.
<br />SEOTION 7. If any provision of this act or the application thereof to any person
<br />or circumstances is held invalid; such Invaliuity shall not affect other proviSions
<br />.or applications of the act which can be given effect without the invalid provision
<br />or application, and to this end the provisions of this act are declared to be
<br />severable.
<br />SECTION 8. The General Assembly hereby finds, determines, and declares that
<br />this act is necessary for the immediate preservation of the public peace, health,
<br />and safety.
<br />SEOTION 9. In the opinion of the General Assembly an emergency exists i there-
<br />fore, this Act shall take effect and be in force from and after its passage.
