<br />. <br /> <br />. <br /> <br />RESOLUTION <br />CONCERNING THE PUEBLO RESERVOIR <br />OPERATING PLAN <br /> <br />WHEREAS, <br />the following <br />tration which <br /> <br />on July 24, 1951, prior to the construction of Pueblo Reservoir, <br />Resolution was adopted by the Arkansas River Compact Adminis- <br />stated in part: <br /> <br />"There shall be no re-regulat,ion of the native waters of the <br />Arkansas River as proposed in such report until a plan of operation, <br />rules, regulations, procedures and agreements in furtherance <br />thereof, including all pertinent agreements between the Corps of <br />Engineers and the Bureau of Reclamation, shall have been submitted <br />to, and approved by the Arkansas River Compact Administration and <br />the affected water users." <br /> <br />WHEREAS, no such plan of operation, rules, regulations or procedures <br />and agreements have ever been submitted to the Arkansas Rivet' Compact <br />Administration for approval and no such operating plan has ever been <br />approved. <br /> <br />NOW, THEREFORE, be it resolved that a draft of the operating plan, as <br />described above, shall be presented by the State of Colorado Compact <br />members to the Arkansas River Compact Administration for approval no later <br />. than April 1, 1983. <br /> <br />FURTHER, Be it resolved that the plan of operation shall include, but <br />not be limited to, the following provisions: <br /> <br />1. That there shall be an annual review of the actual operation <br />of Pueblo Reservoir to determine if any water was impounded in <br />Pueblo Reservoir that would have reached John Hartin Reservoir <br />if Pueblo Reservoir had not existed. <br /> <br />2. That this review shall be made by a representative of the Division <br />of Water Resources of the Kansas State Board of Agriculture <br />and a representative of the Colorado State Engineer's office. <br /> <br />3. That this review shall begin no later than April 1 of each <br />year and shall be completed no later than the following Hay 31st. <br /> <br />4. That the findings of this review shall be submitted to this <br />Administration upon completion. <br /> <br />5. That if it is found that water was stored in Pueblo Reservoir that <br />would have reached John Hartin Reservoir, then thes amount of <br />water shall be released from Pueblo Reservoir and protected covn <br />to John Hartin Reservoer no later than August 1, <br /> <br />. <br /> <br />ATTACHI1ENT K <br />
