Such research resul tE.d in our report <br /> <br />organizations into which irrigation laterals in the Grand Valley <br /> <br />\......J <br /> <br />dated June 10, 1995, entitled Formal Organizations for Operation <br /> <br />of Laterals in the Grand Valley Unit of the Colorado Basin <br /> <br />Salinitv Control Project (referred to below as our "Prior <br /> <br />Report"). We have attempted to limit duplication of the material <br /> <br />contained in our Prior Report in this report, but we should like <br /> <br />to have our Prior Report considered as being incorporated herein. <br /> <br />The initial phase of the present legal work requires our <br /> <br />opinion as to whether amendments to applicable state statutes or <br /> <br />organizational documents of each District are n'~cessary in order <br /> <br />for the Districts to be Contracting Districts. The results of <br /> <br />such initial phase are required to be submitted by the Districts' <br /> <br />legal counsel by August 1, 1986. The following report sets forth <br /> <br />the results of our performance of the initial phase of the legal <br /> <br />work under the June 20, 1986 contract. <br /> <br />II. ASSURANCES THAT ALL COST OF OPERATION <br />AND MAINTENANCE WILL BE REIMBURSED <br /> <br />While not precisely covered by the scope of legal work <br /> <br />required in the June 20, 1986 contract, a problem exists which is <br /> <br />of sufficient importance to both of the Districts that we believe <br /> <br />it should be addressed in this report. Because the problem bears <br /> <br />directly on whether a Salinity Control Contract can be negotiated <br /> <br />with either District, we believe it deserves preliminary <br /> <br />consideration. <br /> <br />It is the present position of the Boards of each District, <br /> <br />-2- <br />
