INTRODUCTION <br /> <br />On June 20, 1986, the State of Colorado, acting through the <br /> <br />Colorado Water Conservation Board, contracted with Mesa County <br /> <br />Irrigation District ("Mesa County District") and Palisade <br /> <br />Irrigation District ("Palisade District") for the performance of <br /> <br />legal, accounting and other work in connection with implementation <br /> <br />of certain provisions of the Colorado River Basin Salinity Control <br /> <br />Act (the "Salinity Control Act"), 43 U.S.C. 1571, et seq. We, <br /> <br />Dufford, Waldeck, Ruland & Milburn, have been ,=mp1oyed by the <br /> <br />Districts to perform the legal work specified in the May 20, 1986 <br /> <br />contracts. The first phase of such work requires a review of the <br /> <br />authorities under which each of the Districts is organized and the <br /> <br />pertinent organizational documents to determinE~ whether each <br /> <br />District currently has the authority and power to acquire such <br /> <br />interests in real property tlnd to do such other things as will <br /> <br />enable it to enter into a contract (a "Salinity Control Contract") <br /> <br />as a Non-Federal entity (referred to in this report as a <br /> <br />"Contracting District(s)") for the construction and long term <br /> <br />operation and maintenance of laterals under the. Salinity Control <br /> <br />Act. <br /> <br />Previously, under contract dated May I, 1985, we were engaged <br /> <br />by the State of Colorado acting through the Colorado Water <br /> <br />Conservation Board, to conduct legal research concerning formal <br /> <br />-1- <br />
