<br />o <br /> <br />~ <br /> <br />00 <br /> <br />~-:"'.I <br />.-, <br /> <br />PROPOSED AMENDMENTS <br /> <br />o <br /> <br />AN ACT <br /> <br />CONCERNING IRRIGATION DISTRICTS WHICH CONTRACT WITH THE UNITED <br />STATES PURSUANT TO THE COLORADO RIVER SALINIT': CONTROL ACT. <br /> <br />Be it enacted by the General Assembly of the Sl:ate of Colorado: <br /> <br />Section 1. Article 43 of Title 37, Colorado Revised Statutes, as <br /> <br />amended, is amended BY THE ADDITION OF THE FOLI,Ol'lING NEW SECTION <br /> <br />to read: <br /> <br />37-43-190 Districts Contracting with United States pursuant <br /> <br />to Colorado River Salinity Control Act. <br /> <br />(1) Ir., this section, a <br /> <br />contract made between an irrigation district, organized under any <br /> <br />statute, and the United States, pursuant to the' Colorado River <br /> <br />Basin Salinity Control Act (43 U.S.C. 1571 et seq.), as such Act <br /> <br />may be supplemented or amended, for the construction, improvement, <br /> <br />operation and maintenance of lateral ditches and pipelines, or for <br /> <br />anyone or more of such purposes, shall be referred to as a <br /> <br />"Salinity Control Contract" and the irrigation district so <br /> <br />contracting as a "Contracting District". <br /> <br />(2) A Contracting District shall have and may exercise all <br /> <br />rights and powers necessary or incidental to enter into, implement <br /> <br />and perform a Salinity Control Contract. <br /> <br />(3) A Contracting District shall have the power of eminent <br /> <br />domain and dominant eminent domain to acquire existing lateral <br /> <br />ditches, pipelines and appurtenances thereto and interests <br /> <br />therein, easements, rights of way and such other rights and <br /> <br />-20- <br />
