The Section does not provide that an irrigation <br /> <br />district organized under the 1901 Law can come within the Law of <br /> <br />1921 by pursuing the procedure specified in said Section <br /> <br />37-42-140. <br /> <br />For the reasons stated above, \oJe recommend the enactment of <br /> <br />the amendment which we have entitled "Remedial Amendment A" hereto <br /> <br />attached as Attachment 2. After enactment thereof we recommend <br /> <br />that a special election be held at which the question be submitted <br /> <br />to the qualified voters of the Palisade Distri,~t of whether to <br /> <br />authorize such district to become subject to the Law of 1921. <br /> <br />V. DE JURE STATUS OF MESA COUNTY DISTRICT <br /> <br />Records filed with the County Clerk of Mesa County, Colorado <br /> <br />reveal that in 1927 Mesa County District called a special election <br /> <br />for vote by its electors upon two questions. ~:he first was <br /> <br />whether the District should become subject to t:he provisions of <br /> <br />the Law of 1921, and the sE!cond was whether the District should be <br /> <br />dissolved pursuant to the Law of 1921 in accordance with a plan <br /> <br />for dissolution specified in the call for such election. The <br /> <br />County Clerk's records indicate that two-thirds of the qualified <br /> <br />electors voted in favor of the first of such questions and that a <br /> <br />majority of the entire voting strength of Mesa County District <br /> <br />voted in favor of the second cf such questions. Copies of <br /> <br />pertinent portions of such records are included in the Appendix to <br /> <br />this report for convenience of reference. <br /> <br />-13- <br />
