Because of t.he importance to a <br /> <br />district of entering into a Salinity Control Contract, we believe <br /> <br />that the execution of such contract should require a vote of its <br /> <br />qualified voters. Accordingly, the language contained in <br /> <br />paragraph (6) of the Proposed Amendments is recommended. This <br /> <br />language provides as follows: <br /> <br />An irrigation district proposing to enter into a Salinity <br />Control Contract, prior to the execution thereof shall submit <br />the question of whether the contract should be made to a <br />special election called for such purpose, which election <br />shall be conducted in the manner required for submission of <br />the question of approval of contracts between a district and <br />the United States as provided by the statutes governing such <br />district. If a majority of the votes cast at such election <br />are in favor of the Salinity Control Contract, the said <br />district shall be entitle~ to execute the contract, and upon <br />doing so shall be deemed to be a Contracting District subject <br />to the provision of this section. <br /> <br />IV. STATUTE GOVER~ING PALISADE DISTRICT <br /> <br />The records of the Mesa County Clerk show that Palisade <br /> <br />Irrigation District was organized under the Irrigation District <br /> <br />Law of 1901 which apparently was superceded by the Law of 1905. A <br /> <br />copy of the pertinent part of such records is i'~cluded in the <br /> <br />Appendix to this report.
