This <br /> <br />C) language provides as follows: <br /> <br />If, and to the extent, title to property acquired by a <br />Contracting District is required to be transferred or <br />conveyed to the United States under a Salinity Control <br />Contract, a Contracting District shall hav,~ power and <br />authority to make such transfers or conveyances without the <br />necessity of approval thereof by a vote of the qualified <br />voters of the said District. <br /> <br />7. Plans Need Not be Submitted to State Engineer or <br /> <br /> <br />Irrigation Commission. Sections 37-41-104(1), C.R.S., of the Law <br /> <br />of 1905 and 37-42-117 of the Law of 1921 require the submission to <br /> <br />the state engineer or the irrigation district commission, as the <br /> <br />case may require, of a plan of the project to be constructed by a <br /> <br />district. Such a requirement seems to us to bE! inapplicable to a <br /> <br />Contracting District functioning under a Salinity Control <br /> <br />Contract. Accordingly, we propose the lanaguage set forth in <br /> <br />paragraph (5) of the Proposed amendments which provides as <br /> <br />follows: <br /> <br />A Contracting District shall not be required to submit to the <br />state engineer or irrigation district commission a plan of a <br />project to be constructed or operated and maintained under a <br />Salinity Control Contract, to supply other information <br />concerning the project to the state engineer or irrigation <br />district commission nor obtain a decision from such official <br />or commission as to the feasibility of such project, any <br />statute to the contrary notwithstanding. <br /> <br />8. Authorization of a Salinity Control Contract by Vot~rs <br /> <br />of District.
