Entities that clioose to secure an allotment contract In <br />the EWMS, if such space is available, will be required to reimburse the Enterprise for the <br />implementation costs, capital costs for the construction of EWMS, pay the 15 percent <br />mitigation costs, and any appropriate interest charges, in proportion to their storage request. <br />These funds will be credited to the Enterprise's Water Activity Fund for SOD repayment and <br />Project O&M. <br /> <br />3.8 Use of Enlarged Storage Space-Enlarged space will not be used to store additional Fry- <br />Ark Project Water. The first priority for use of the additional storage space will be for the <br />storage of water by entities that have contracts for firm storage (allotment contracts), <br />proportionate to their share of the enlarged space. Water stored by contracting entities must be <br />legally and physically available under decrees held by the contracting entities; and, storage in <br />enlarged space is subject to the limitations as established by the authorizing legislation and <br />master storage contract with Reclamation. <br /> <br />Allotment contract holders may store water that is intended for re-sale. Allotment contract <br />holders may sub-lease their storage space to other water users within the District. However, <br />when the allotment contract holders are not fully utilizing their storage space, the Enterprise <br />will have the first option to store water on an If & When basis. This water, stored by the <br />Enterprise, will be subject to spill if and when the allotment-contract holders need the space for <br />their use, and when no other enlarged space is available for such temporary storage. <br /> <br />. <br /> <br />The District will hold a right to store native water in the enlarged space under a 2000 <br />appropriation date, when that right is in priority and only when space is available. A portion of <br />the enlarged space will be designated as Enterprise Water Management Storage (uses for the <br />EWMS are described in Section 4 of this Implementation Committee Report). When EWMS is <br />not being used for Enterprise purposes it will be available for use by allotment contract holders <br />on an If & When basis, subject to an appropriate charge for the O&M costs associated with <br />EWMS. <br /> <br />3.9 Limitations and Obligations-The following limitations and obligations will apply to all <br />entities that agree to secure an allotment contract in the proposed enlarged storage capacity in <br />Pueblo Reservoir and Turquoise Reservoir: <br /> <br />. <br /> <br />1. Enterprise Water Management Space - Each participant in the enlargement project will <br />be obligated to fund the development of an additional 15 percent of storage space over- <br />and-above their individual storage needs. Such storage space will be designated as <br />Enterprise Water Management Storage and used as described in the EWMS Section of <br />the Implementation Committee Report. <br />2. Re-operations Contract - Participating entities that are eligible to use re-operations <br />space must be making payment under contract with Reclamation for the use of such <br />space. Payments under the existing long-term If and When storage contract held by <br />Board of Water Works of Pueblo meets this obligation. <br />3. Flow Management Program - Firm-storage allotment contract holders, like re-operations <br />contract holders, agree to participate in a cooperative flow management program <br />designed to achieve a 100 cfs target minimum flow on the Arkansas river immediately <br />below Pueblo Dam. <br />4. Long-Term Water Quality Monitoring Program - Participating entities in either re- <br />operations or the enlargement projects will be required to participate in a long-term, <br />water-quality monitoring program. This program includes a "water quality management <br />program" which will be implemented if water quality degrades to a level defined as <br />significant (based upon specific conductance as an indicator parameter). The significant <br />threshold level will be determined by the members of the water quality sub-committee in <br /> <br />3/20/02 <br />
