<br />The District's use of Hoover energy increased rapidly in the early
<br />1%0', and by the year 1954-55 exceeded the growth limit set by
<br />Article 202a of the Collateral Contract causing the use of "excess
<br />energy," By May 31, 1959, the District's use of "excess energy" had
<br />totaled 804,991,127 kwh\"' The computation of the District's excess
<br />energy payments to compensate the City of Los Angeles, the Sou-
<br />thern California Edison Company and the California Electric
<br />Power Company for their C08t in replacing the "excess energy" was
<br />controversial and 3S a result a compromise settlement was negoti-
<br />ated, On December 30, 1958, agreements were consummated for the
<br />settlement and release of all present and future claims by the City
<br />of Los Angeles, Southern California Edison Company and Califor-
<br />nia Electric Power Company for the District's use of "excess en-
<br />ergy," and the District made payments totaling $1.877,377,
<br />
<br />A new contract known as the District's 1958 Resale Contract was
<br />executed January 29, 1960, to take effect May 30, 1958, and upon
<br />its execution, the District's 1945 Resale Contract, the Collateral
<br />Contract and the District-Edison Joint Transmission Line Contract
<br />were terminated, and the District-Edison 1958 Service and Inter-
<br />change Contract described in the section on Power Resources be-
<br />came effective, The 1958 Resale Contract is essentially the same as
<br />the 1945 Resale Contract with the deletion of obsolete sections and
<br />the recognition of all new developments related to the contract,
<br />
<br />Other contracts in effect at this time include those resulting from
<br />the settlement of the claim of Citizens Utilities Company against
<br />the United States for non-continuance of District unused energy
<br />from Hoover power plant in 1954, The settlement provides Citizens
