<br /> <br />o <br />o <br />("::> <br />..> <br />Co..:> <br />~ <br /> <br />. <br /> <br />. <br /> <br />the situation and develop the most appropriate response to <br />restore the Program as a reasonable and prudent alternative <br />(such as adjusting the LRP so the action can be achieved, <br />developing a supplemental recovery action for incorporation <br />into the LRP that will serve as the reasonable and prudent <br />alternative, shortening the time frame on other recovery <br />actions, etc.). <br /> <br />~ If the Program cannot be restored to provide the <br />reasonable and prudent alternative for previously rendered <br />biological opinions per item 10 above, as a last resort the <br />Service will develop a reasonable and prudent alternative, if <br />available, with the lead Federal Agency and th$.project <br />proponent. (Program participants recognize that such actions <br />would be inconsistent with the intended operation of the <br />Program). The option of requesting other measures on new or <br />histeric existing projects will only be used in the event <br />that the LRP is not or cannot be amended to serve as a <br />reasonable and prudent alternative. In this situation, the <br />reasonable and prudent alternative will be consistent with <br />the intended purpose of the action, within the Federal <br />Agency's legal authority and jurisdiction to implement, and <br />will be economically and technologically feasible. <br /> <br />c) A ~roiect (identified action) is subsequentlY modified in <br />a manner that causes an effect to a listed species or <br />critical habitat that was not previouslvconsidered. If <br />water projects are modified in such a manner so as to <br />tri~~er cause reinitiation of consultation, the Service will <br />identify additional or different action items from the ~ <br />range plan LRP to serve as reasonable and prudent <br />alternatives for the project. <br /> <br />d) The Service lists new species or desiqnates new or <br />additional critical habitat. and water manaqement activities <br />mav have an adverse impact on the newlv listed species or <br />habitat. The Service will make recommendations to the <br />Coordination Committee for amendments to the Program and <br />leH~ TaHge ~lafi LRP to avoid the likelihood of jeopardy, <br />adverse modification of critical habitat, or to minimize <br />take for any new species listed as threatened or endangered. <br />The Program participants will then decide whether to make <br />the amendments. If the amendments are made, the Service will <br />reinitiate consultation, and will use the amended long range <br />plan action items as reasonable and prudent alternatives. <br />The Service will not require any additional recovery <br />actions by individual projects, because such actions would <br />be included in the long range plan.
