<br /> <br />'I _,' <br /> <br />. <br /> <br />. <br /> <br />o <br />o <br />l:' <br />~Did not finish from here down, will discuss on the 20'h.) <br />-..:I Note: The Ad Hoc Committee also discussed the possibility of some type of consultation on <br />implementation of the Program that would deal with all actions resulting in incidental take, <br />not just federal actions, The approach above only provides incid~nial take coverage for <br />actions addressed in biological opinions, Additional discussion is needed on this item. <br /> <br />and implement the terms and conditions or (2) fails to retain oversight to ensure compliance with <br />these terms and conditions, the protective coverage of section 7(0)(2) may lapse. <br /> <br />8,0 REINITIATION OF CONSULTATIONS <br /> <br />This section discusses reinitiation of consultation on water projects for which the Program is <br />providing the reasonable and prudent alternative,' <br /> <br />As provided in 50CFR402.l6, reinitiation offormal consultation is required where discretionary <br />Federal agency involvement or control over the action has been retained (or is authorized by law) <br />and ifone of the following occurs: <br /> <br />a) The amount or extent of take specified in the incidental take statement in <br />biological opinions is exceeded. <br /> <br />b) New information reveals effects of the action that may affect listed species or <br />critical habitat in a manner or to an extent not considered in the BO. <br /> <br />c) A project (identified action) is subsequently modified in a manner that causes <br />an effect to a listed species or critical habitat that was not considered in the BO. <br /> <br />d) The Service lists new species or designates new or additional critical habitat <br />that may be affected by the identified action. <br /> <br />If the Service or an action agency determines that reinitiation of consultation on water projects <br />may be necessary for any reason, it will provide such information to the Federal action agency, <br />the project sponsors, and to the Coordination Committee. Program participants will participate <br />in finding solutions to the problem which could trigger the reinitiation of consultations. Only if <br />the Program cannot implement recovery actions to remove the cause of reinitiation will the <br />Sef\'iee reiaitiateformal consultation be reinitiated on individual waterprojects, and/or reE[llire <br />project sponsors be required to provide reasonable and prudent alternatives. <br /> <br />If the Program cannot provide reasonable and prudent alternatives, project sponsors may <br />choose to provide the reasonable and prudent alternatives independently of the program. <br /> <br />With respect to the specific reasons listed above, should the Service or action agency find cause <br />for reinitiation, the following courses of action will be taken: <br /> <br />11 <br />
