<br />0:. <br />= <br />C' <br />t": <br /> <br />C;: <br /> <br />::~1~ <br /> <br />the regulations are to be consistent and coordinated with the implementation <br />of Executive Order 11988, the National Environmental Policy Act and similar <br />authoriti~s. finally, the regions, states and local governments are to give <br />full consideration to non-structural mitigation measures. <br /> <br />In accordance with these interpretations and principles, the regulations <br />rely primarily on three devices to ensure the implementation of Section 406. <br />Initially, the Regional Director must include appropriate provisions for <br />hazard mitigation in the federal/state agreement. Under the "typical para- <br />graph,,(a) set out to serve this purpose, the state would agree to: 1) <br />evaluate, or have the disaster assistance applicant evaluate, the natural <br /> <br />(~ii) , <br />'..;,)- <br /> <br />(a) The following represents the "typical paragraph" that has <br />been added to the federal/state agreement in order to clarify Subpart <br />M, Section 406 responsibilities. <br /> <br />The State agrees that, as a condition for any Federal loan or <br />grant, the State or the applicant shall evaluate the natural <br />hazards in the areas in which the proceeds of the grants or loans <br />are to be used and shall make appropriate recommendations to miti- <br />gate such hazards for federally-assisted projects. The State <br />further agrees: (1) to follow up with applicants, within State <br />capabilities, to assure that, as a condition for any grant or loan <br />under the Act, appropriate hazard mitigation actions are taken; <br />(2) to prepare and submit not later than 180 days after the decla- <br />ration to the Regional Director for concurrence, hazard mitigation <br />plan or plans for the designated areas, and (3) to review and up- <br />date as necessary disaster-mitigation portions of the emergency <br />plans. <br /> <br />The Regional Director agrees to make Federal technical adyice and <br />assistance available to support the planning efforts and actions. <br /> <br />A-2 <br />
