The Type 1 right <br /> <br /> <br />is based upon having purchased ~nd retired agricultural land~ and <br /> <br /> <br />is limited to three acre-feet par acre. Tha othar ana, Type 2, is <br /> <br /> <br />an industrial or municipal right based on historical usa during the <br /> <br /> <br />maximum year of the five preceding years. <br /> <br /> <br />Now the grandfathered rights may be sold or conveyed to new <br /> <br /> <br />users. A farmer may sell the right to use his full irrigation <br /> <br /> <br />grandfathered right, whatever the duty of that happens to be at <br /> <br /> <br />that point, times the number of acres. He can sell that whole right <br /> <br /> <br />to another farmer for irrigation use, but if he sells it to a sub- <br /> <br /> <br />divider or an industry, he can sell a maximum of three acre-feet <br /> <br /> <br />per acre. In general, the cities and irrigation districts may pump <br /> <br /> <br />as much groundwater as needed to meet the needs within their <br /> <br /> <br />service areas, subject .to the conservation requirements and the <br /> <br /> <br />duties that are established by the Director as a part of the manage- <br /> <br /> <br />ment plan. Anyone wanting to use water - to pump additional water <br /> <br /> <br />in an active management area for purposes other than irrigation - <br /> <br /> <br />must file for a new permit with the Department and there are specific <br /> <br /> <br />conditions set forth in the law under which the Director can grant a <br /> <br /> <br />new permit for mine dewatering, mineral extraction, metallurgical <br /> <br /> <br />processing, general industrial, poor quality water withdrawal and <br /> <br /> <br />drainage, and then some temporary permits for electrical generation <br /> <br /> <br />and for dewatering during construction. <br /> <br /> <br />The Director, and this is probably going to be the toughest <br /> <br />part of this bill for the Department to perform, is required to <br /> <br />B-15 <br /> <br />
