<br />. <br /> <br />. <br /> <br />," .",: r. ~ I <br />(f .:.. ~. . <br /> <br />-43- <br /> <br />This statement of fundamental purpose encompasses a variety of consumptive <br />and non-consumptive reserved water rights necessary to conserve scenic, <br />natural, historic and biotic elements and to provide for ~ustalned <br />public enjoyment thereof. <br /> <br />I conclude that the particular reserved water rights for national park <br />areas encompassed under 16 U.S.C. 5 I Include water required for: <br /> <br />':"~:::::T-:: <br /> <br />I. Scenic, natural and historic conservation uses, <br />such" as: --ecosystem" ma"lntenance"'e:g;- protecting <br />forest growth and vegetatIve cover, watershed pro- <br />tection, sol I and erosion control, lawn watering, <br />fire protection), maintenance of water-related <br />aesthetIc conditions (e.g,. minimum stream flows <br />and lake levels), and maintenance of natural <br />features (e.g., wi fderness protection, geysers, <br />waterfalls). <br /> <br />2. WIldlife conservation uses, such as: the <br />protectTon~-reproductTon-and management of <br />migratory wi Idl Ife and birds (e.g., wi Idflfe <br />and bird watering. habitat maintenance, Irri- <br />gation for hay and other food staples); and <br />the protection, reproductlon and management <br />of fish and other aquatic life (e.g., mini- <br />mum stream flows and lake levels). <br /> <br />~'~.~:-.~ <br /> <br />3. Susta~~sJ_f>u.Q~_enloY'!!.~! ~~~~. such as: <br />visitor accommodatIon uses through NPS and <br />concessloneer operations (e.g., campground <br />uses and maintenance, hotel water and <br />sewer uses), public facility uses (e.g., <br />water fountains. sewage), visitor activitIes <br />(e.g" visitor centers, park office. shop <br />uses); and vIsItor enjoyment of the scenIc. <br />natural, historic and biotic park resources (e.g., <br />tral I maintenance. mInImum stream flows and lake <br />levels for water~borne public enjoyment and <br />recreation, hay and watering of horses and mules <br />used by park visItors), <br /> <br />4, ~~?_P~~~9~~~~u~e~ to provide the above uses. <br />such as domestic uses (ranger stations, NPS <br />residences), NPS animal maintenance (e.g., hay <br />and watering of NPS horses and mules). <br /> <br />:. :~ <br /> <br />.:.r. <br />
