Furthennore, thIs EIS Is not Intended to represent <br />the present or future positIon of either the State of Colorado or of <br />the State of Utah or of the United States with regard to matters <br />concerning the apportionment of the waters of the White River. <br /> <br />1.2 PURPOSE AND NEED FOR THE PROPOSAL <br /> <br />1.2.1 The Water Users AssocIation No.1, a subdistrict of the <br />Colorado River Water Conservation DistrIct, currently possesses a <br />water right for storage of 13,800 acre-feet (AF) C17xI06m3) on the <br />White River at the Taylor Draw sIte. The water right was transferred <br />from CRWCD's Rangely Reservoir decree (CA #1269) several miles <br />upstream of the Taylor Draw site. The decree was adjudicated on July <br />20, 1966 with an appropriation date of July 3, 1962, Approval of this <br />transfer by the Water Court Is pending, The Colorado River Water <br />Conservation District (CRWCD) was created by the Colorado General <br />Assembly In 1937 to safeguard, conserve, and put to beneficial <br />consunpt I ve use water apport loned to the State of Colorado by the <br />Colorado River Compact of 1922 and the Upper Colorado River Basin <br />Compact of 1948, The CRWCD covers all of twelve COlorado Counties and <br />a portion of three additional counties west of the continental divide <br />and north of the San Juan Mountains, Water Users Association No. 1 <br />was established by court decree on November 7, 1977 after presentation <br />of a petition signed by over 50% of the real property owners In the <br />Association and encompasses land and real property In Rio Blanco <br />County, Colorado. The CRWCD has the authority of eminent domain that <br />can be exercised on behalf of a project to be financed by Water Users <br />Association No, 1. The AssocIation has presently reached agreement <br />with 75% of the land owners within the reservoir basin without use of <br />this authority, The CRWCD may also Issue general obligation bonds In <br />the name of the subdistrict to finance a project. The Association was <br />formed to develop water rights held by the CRWCD within the <br />Association for all beneficial purposes, On August 19, 1980, voters <br /> <br />2 <br />
